1) Acceptance of Terms

These Terms of Use (“Terms”) form a legal agreement between you and SnapHabit LLC (“we,” “us,” “our”) governing your use of the AwareFlow™ iOS app and the website at awareflow.app (together, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2) Eligibility

You must be at least 13 years old (or the age of digital consent in your region) to use the Services. If you are under 18, you represent that you have permission from a parent or legal guardian.

3) Purpose & No Professional Advice

AwareFlow™ is a personal-awareness and habit-reflection tool. It does not provide medical, psychological, or therapeutic advice and is not a substitute for professional care. Seek appropriate professional help if you have concerns about your health or wellbeing.

4) Privacy & Data

AwareFlow is designed as a privacy-first app. Habit detection runs on-device, and audio is never uploaded, stored, or transmitted to SnapHabit LLC. For detailed practices, see our Privacy Policy and Confidentiality. By using the Services, you consent to those policies.

5) Your Content & Sharing

You may optionally add notes, reflections, or exported images (“Your Content”). Your Content stays on your device unless you explicitly choose to share or export it. When you share content through other apps (e.g., Messages, Mail, cloud drives), that content is governed by those services’ policies and terms.

You are solely responsible for Your Content and for ensuring that you have all rights needed to share it. Do not upload or share content that violates laws, infringes rights, or harms others.

6) Permissions & Controls

Sensitive features are opt-in and are explained in the app before use. These may include: Microphone, Notifications, Motion, Bluetooth accessories, Photos (when you select media), Contacts (when inviting or sharing), Calendars (context for nudges), Location (local context such as weather/time), Face ID (App Lock), Siri interactions, and Live Activities.

You can change or revoke permissions at any time in iOS Settings → AwareFlow.

7) Acceptable Use

• Do not misuse the Services or interfere with normal operation.
• Do not reverse engineer, decompile, or access source code except as allowed by law.
• Do not use the Services for unlawful, harmful, threatening, discriminatory, or harassing activities.
• Do not violate others’ rights, privacy, or intellectual property.

8) Intellectual Property

AwareFlow™, SnapHabit™, and all related content, graphics, software, trademarks, and materials are owned by SnapHabit LLC or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, revocable license to use the app for personal, lawful purposes.

9) Purchases, Pricing & Refunds

Purchases through the Apple App Store are processed by Apple. Pricing may vary by region. Renewals, cancellations, and refunds follow Apple’s policies. Refund requests can be submitted at reportaproblem.apple.com.

10) Third-Party Services

If we link to third-party websites or services, we are not responsible for their content, availability, policies, or practices. Review third-party terms before using them.

11) Updates & Availability

We may update, modify, or remove features at any time. Updates may be required to continue using the Services. Service availability may be interrupted for maintenance or reasons outside our control.

12) Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or for other legitimate reasons. You may stop using the Services at any time. Upon termination, all rights granted to you under these Terms cease.

13) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPHABIT LLC AND ITS OWNERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $25.

15) Indemnification

You agree to indemnify and hold SnapHabit LLC harmless from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

16) Governing Law & Venue

These Terms are governed by the laws of the State of Arizona, USA. You agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

17) Changes to These Terms

We may update these Terms periodically. Significant updates will be noted on this page. Continued use after updates take effect constitutes acceptance.
